The Douglasville Municipal Court is the judicial branch of the City of Douglasville. The Court Services Division includes five full-time employees, three part-time employees, the clerk, the solicitor, and the judge. The Court Services Division is responsible for processing all traffic citations and misdemeanor state law violations issued by the Police Department, including ordinance violations issued by the Community Development’s Code Enforcement and Animal Control, processing all violations of probation issued by Judicial Correction Services, preparing dockets, and collecting fines and fees. The Court Services Division holds separate sessions for traffic citations, code enforcement citations, and violations of probations. Traffic/Misdemeanor Court sessions are held for various traffic infractions such as speeding tickets, suspended license, DUI, Shoplifting, and Possession of Marijuana less than one ounce. Code Enforcement Court sessions address property maintenance, animal control, and other environmental degradation cases. Probation Violation Court sessions bring back probation cases for review and defendants that have violated conditions of their court orders.
Traffic/Misdemeanor Court is usually held every Wednesday and Thursday. Court always commences at 8:30 am. It is held at the Douglasville Public Safety building located at 2083 Fairburn Road, Douglasville, GA 30135.
Douglas Municipal Court is a court of limited jurisdiction. Motions to suppress and jury trials cannot be heard here. The State Court of Douglas County inherited all active traffic citations from the Probate Court effective July 1, 2001. The caseload has increased since that time, and will continue to increase with the addition of the Sheriff’s Department new task forces. Over 7500 new traffic citation cases were filed in the first six months of the Court’s life. Over 15,000 traffic citation cases are anticipated in 2002. Criminal misdemeanor and civil cases are filed and maintained in the Clerk of State Court office. Each case is assigned a number and judge. Each criminal case could have more than one defendant and numerous charges. Each civil case could have numerous parties as plaintiff or defendant. The Solicitor General’s Office, the Public Defender’s Office, private attorneys, plaintiffs or defendants will file all original documents pertaining to the case in the Clerk of State Court. Once a criminal case is sentenced or closed, the office processes the necessary paperwork to send to the applicable State agency. Fines are paid either to the Clerk of State Court or to the Probation Office, and the Clerk of State Court processes and disburses the monies to twelve local and State agencies.
ADMINISTRATIVE LICENSE SUSPENSION HEARING If you have been arrested for DUI and blew over the legal limit for someone of your age and drivers license class, then the law requires that the arresting officer give you a temporary license (8.5 x 11 yellow paper). This temporary license is known as form DS-1205 and also acts to serve notice to you that your license will be suspended 30 days from arrest unless you send in $150 to the Georgia Department of Drivers Services requesting an Administrative License Suspension (ALS) Hearing.
An ALS Hearing is a civil action taken by the State of Georgia to try to suspend your license before the adjudication (resolution) of your criminal DUI case. The administrative license suspension case is an important and, frequently, a critical part of your DUI case. With the filing of a request for hearing within 10 days from the date of arrest, your driving privileges are extended beyond the 30 days, which your temporary permit is valid for.
